LIMITED PRODUCT WARRANTY – FUSION PLUS PAINT & PPF 

This Limited Product Warranty (the “Warranty”) is provided by XPEL, Inc. (the “Company”) to the original owner of the FUSION PLUS PAINT & PPF (the “Product(s)”) and applies to the Products installed in accordance with the Company’s recommendations by a professional installer. The Company warrants that the Product(s) will be free from manufacturing defects in materials and workmanship for a period of four (4) years (the “Warranty Period”) from the date of initial installation. 

During the Warranty Period, the Company will cover the vehicles paint finish on the Product(s) against oxidation, loss of gloss, UV damage, and color fading. If the Product(s) fails or does not perform as warranted solely due to a manufacturing defect within the Warranty Period, the Company will, at its option, remove or replace the Product without charge or refund the cost of the Product, subject to the exclusions set forth in this Warranty. The maximum replacement cost to be paid by the Company shall be the lesser of the cost of the coating application or $1000. The Company will cover parts, and the authorized installer will be responsible for providing installation labor. Refund of the cost of the Product or replacement of the defective coating are the exclusive remedies for all Products covered under this Warranty. 

The Company’s obligation as to repair or replacement shall further be limited to repair or replacement with the Products that are available at the time of the repair or replacement, shall be limited to the repair or replacement of only the specific Product that fails due to a manufacturing defect, and shall not extend the original Warranty Period in any manner or start a new warranty period. Any repaired or replaced product shall also remain subject to the Warranty Period. 

To obtain coverage under this Warranty, the original owner must provide the Company with a proof of warranty card, a copy of the original receipt for the Product identifying the coverage areas, and a detailed description of the purported defect. The original owner must notify the authorized Company installer who performed the installation of the Product, in writing, providing claimant’s name, phone number, address, and the installation address (if different), a description of the product involved, and the nature of the defect. 

This Warranty is transferable only when the new owner submits to the Company proof of the original date of installation. Transfer of the Warranty only entitles the new owner coverage for the remainder of the original Warranty Period. 

This Warranty is the exclusive warranty provided by the Company for the Products, and no other warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose, shall apply. The Company shall not be liable for any indirect, special, incidental, or consequential damages arising from the use of the Products. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. 

This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. This Warranty shall be governed by and construed in accordance with the laws of the state in which the Product was purchased, without giving effect to any conflict of laws principles. 

Disclaimer of Warranties 

The Company warrants that its Products will conform to the Company’s guides and instructions for storage, handling, installation, use, and maintenance, subject to compliance with all instructions. Copies of the Company’s guides and instructions are available upon request from the Company at the address provided below or on the Company’s website at www.xpel.com/fusion-plus. 

This Limited Warranty does not apply to defects caused by any of the following: 

  1. Failure to comply with the Company’s guides or instructions, including but not limited to physical abuse, chemical abuse, thermal abuse or shock, or misuse; 
  1. Improper storage, installation, handling, or use of the Product; 
  1. Damage that occurs while the Product is in the customer’s possession and not resulting from manufacturing defects; 
  1. Unreasonable or unintended use of the Product; 
  1. Products installed with known or visible manufacturing defects at the time of installation, including scratches, scuffs, scrapes, and chips to the painted surface; 
  1. Minor conditions such as stains and scratches; 
  1. Damage to the coated surface due to improper wash techniques, automatic car washes, or incorrect wash tools that may cause abrasion or by third parties not authorized by the Company; 
  1. Scratches, scuffs, scrapes, and chips to the painted surface; 
  1. Water spots, which are caused by mineral deposits and are not covered; 
  1. Damage caused by collision, accidental damage, vandalism, fire, hail, flood, stones, surface rust, rail dust, physical damage, paint overspray, or vehicle manufacturer’s defects, which may be covered under a manufacturer’s protection plan; 
  1. Areas that have not been re-coated after a paint or body repair; 
  1. Use in non-automotive applications. 

Any information or suggestion provided by the Company with respect to the Products concerning applications, specifications, or compliance with codes and standards is provided solely for your convenient reference and is made without any representation as to accuracy or suitability. You must verify and test the suitability of any information with respect to the Products for your specific application. 

THE WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES MADE BY THE COMPANY IN CONNECTION WITH THESE PRODUCTS. THE COMPANY CAN NOT AND DOES NOT MAKE ANY IMPLIED OR EXPRESS WARRANTIES WITH RESPECT TO THE PRODUCT, AND DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. PRODUCTS SOLD BY COMPANY ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY COMPANY IN WRITING. OTHER THAN THE LIMITED WARRANTY SET FORTH HEREIN, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. THE COMPANY’S SOLE OBLIGATION UNDER THIS WARRANTY SHALL BE REPAIR OR REPLACEMENT OF NON-CONFORMING PRODUCTS, OR AT THE OPTION OF THE COMPANY, RETURN OF THE PRODUCT AND A REFUND OF THE PURCHASE PRICE. BUYER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF THE PRODUCTS PURCHASED, WHETHER USED SINGULARLY OR IN COMBINATION WITH ANY OTHER PRODUCTS OR SUBSTANCES.  

Limitation Of Liability  

NO CLAIM BY THE BUYER/OWNER OF ANY KIND, INCLUDING CLAIMS FOR INDEMNIFICATION, SHALL BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT TO WHICH DAMAGES ARE CLAIMED. IN NO EVENT SHALL THE COMPANY BE LIABLE TO BUYER/OWNER IN TORT, CONTRACT OR OTHERWISE, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES, INCONVENIENCE, LOSS BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN, IN CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY WITH RESPECT THERETO. THIS DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT. 

Annual Inspections 

Annual Inspections Annual inspections must be carried out by an XPEL Certified Installer, within thirty (30) days before or after the installation date of the application or last service date. Failure to complete the inspection, within the required time will void the Limited Warranty. Any fees or charges by the XPEL Certified Installer will be charged to the owner to do the annual inspection including, but not limited to, exterior wash, decontamination, and inspection. Please keep proof of all inspections, as they must be provided if you have a Limited Warranty related issue.

 Limited Product Warranty PRIME ™ Automotive Window Film 

 

XPEL, Inc. (the “Company”) expressly warrants to the owner that, for the life of your vehicle (the “Warranty Period”) from the date of initial installation. The Company will cover defects on the PRIME Automotive Window Film (the “Product(s)”) such as: discoloration, fading, bubbling, peeling, cracking, and delamination. This Limited Warranty only applies to the Company’s Products which are professionally installed in the manner recommended by the Company. 

The Company warrants that the Product sold to the Buyer/Owner, hereinafter referred to as “Claimant”, will be free from manufacturing defects for a period of time specified in the Limited Warranty, hereinafter referred to as the “Warranty Period”. If the Product fails to perform as warranted solely due to a manufacturing defect within the Warranty Period, The Company will, at its option, remove or replace the Product without charge, subject to the exclusions set forth in this Limited Warranty. 

In the event that The Company elects to replace the Product, an authorized installer chosen by The Company will remove and reapply the Product to areas that The Company, in its sole discretion, determines to be covered by this Limited Warranty. The Company will cover parts and labor. The exclusive remedy for all Products covered under this Limited Warranty is the replacement of the defective film. The Company’s obligation as to repair or replacement during the entire Warranty Period shall be limited to repair or replacement with the Products that are available at the time of the repair or replacement, and shall be limited to the repair or replacement of only the specific Product that fails due to a manufacturing defect. Any repaired or replaced Product shall also remain subject to the Warranty Period, and any repair or replacement shall not extend the original Warranty Period in any manner or start a new warranty period. These are the exclusive remedies for all Products covered under this Limited Warranty. 

Claimant may obtain coverage under this Limited Warranty by providing The Company with proof of warranty card, copy of original receipt for the Product identifying coverage areas, along with a detailed description of the purported defect. For service under this Limited Warranty, Claimant must notify the authorized installer who performed the installation of the Product, in writing, providing claimant’s name, phone number, address, and the installation address (if different), a description of the Product involved, and the nature of the defect. 

This Limited Warranty is transferable only when the new owner submits to The Company proof of the original date of installation. Transfer of the Limited Warranty only entitles the new owner coverage for the remainder of the original Warranty Period. 

Disclaimer Of Warranties 

The Company’s Products must be stored, handled, installed, used, and maintained in accordance with instructions provided by the Company, and this Limited Warranty is conditioned upon compliance with all such instructions. Warranty Coverage 

This Warranty does not cover defects caused by: 

  1. non-compliance with the Company’s guide or instructions. Such failures include, but are not limited to, exposure to physical abuse, including, but not limited to chemical abuse (e.g., harsh cleansers and solvents), thermal abuse or shock (e.g., excessive heat or cold) or misuse; 
  1. improper storage, installation, handling and/or use of the Product; 
  1. damage not resulting from manufacturing defects that occur while the Product is in the customer’s possession; 
  1. unreasonable or unintended use of Product; 
  1. Products installed with known or visible manufacturing defects at the time of installation, including, but not limited to scratches, scuffs, scrapes, chips to the tinted surface; 
  1. Stains, and scratches; 
  1. Damage to the tinted surface due to improper wash techniques, automatic car washes or incorrect wash tools that may cause abrasion or by third parties not authorized by the Company; 
  1. Scratches, scuffs, scrapes, chips to the tinted surface; 
  1. Damage caused by collision, accidental damage, vandalism, fire, hail, flood, surface rust, rail dust, physical damage, paint overspray, or glass manufacturer’ defects, which may be covered under manufactures protection plan; 
  1. Use in non-automotive applications. 

Any information or suggestion by the Company with respect to the Products concerning applications, specifications or compliance with codes and standards is provided solely for your convenient reference and are made without any representation as to accuracy or suitability. You must verify and test the suitability of any information with respect to the Products for your specific application. 

No Other Warranties 

THE WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES MADE BY THE COMPANY IN CONNECTION WITH THESE PRODUCTS. THE COMPANY CANNOT AND DOES NOT MAKE ANY IMPLIED OR EXPRESS WARRANTIES WITH RESPECT TO THE PRODUCT, AND DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. PRODUCTS SOLD BY COMPANY ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY COMPANY IN WRITING. OTHER THAN THE LIMITED WARRANTY SET FORTH HEREIN, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. 

Limitation Of Liability 

THE MAXIMUM LIABILITY OF THE BUYER/OWNER FOR ANY CLAIM, INCLUDING INDEMNIFICATION CLAIMS, SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT(S) THAT IS/ARE THE SUBJECT OF THE CLAIM. UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO THE BUYER/OWNER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES, INCONVENIENCE, LOSS OF BUSINESS OPPORTUNITIES, DAMAGE TO GOODWILL OR REPUTATION, OR LOSS OF DATA, EVEN IF THE POSSIBILITY OF SUCH DAMAGES HAS BEEN ADVISED OR FORESEEN, ARISING FROM OR IN CONNECTION WITH THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREIN, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY.

Limited Product Warranty for ULTIMATE PLUS & STEALTH PPF 

This Limited Product Warranty (“Warranty”) is offered by XPEL, Inc. (“Company”) and is expressly granted to the original owner of the ULTIMATE PLUS & STEALTH paint protection films (“Products”) for a period of ten (10) years (the “Warranty Period”) from the date of initial installation, subject to the terms and conditions set forth herein. The Warranty only applies to the Products that have been professionally installed in accordance with the Company’s recommended installation procedures. 

During the Warranty Period, the Company warrants that the Products will be free from manufacturing defects that result in yellowing, cracking, blistering, or delaminating. If the Products fail to perform as warranted solely due to a manufacturing defect within the Warranty Period, the Company, at its option, will remove or replace the Products without charge. The Company will cover parts and labor for the replacement of the defective film, which is the exclusive remedy for all Products covered under this Warranty. However, any repair or replacement of the Products will not extend the original Warranty Period or start a new warranty period. 

In order to obtain coverage under this Warranty, the owner must provide the Company with a proof of warranty card, a copy of the original receipt that identifies the coverage areas, and a detailed description of the purported defect. To file a claim under this Warranty, the owner must notify the authorized Company installer who performed the installation of the Products in writing, providing claimant’s name, phone number, address, and the installation address (if different), a description of the product involved and the nature of the defect.

  1. Non-compliance with the Company’s guide or instructions, including exposure to physical abuse, chemical abuse, thermal abuse or shock, or misuse.

  1. Damage not resulting from manufacturing defects that occur while the Products are in the owner’s possession. 
  1. Unreasonable or unintended use of the Products.

  1. Damage to the wrapped surface due to improper wash techniques, automatic car washes, or incorrect wash tools that may cause abrasion, or by third parties not authorized by the Company.

  1. Water spots, which are caused by mineral deposits and not covered by this Warranty. 
  1. Damage caused by collision, accidental damage, vandalism, fire, hail, flood, surface rust, rail dust, physical damage, paint overspray, or paint manufacturer’ defects, which may be covered under the manufacturer’s protection plan. 
  1. Areas that have not been re-wrapped after a paint or body repair. 
  1. Use in non-automotive applications. 
  1. Use of non-XPEL approved chemicals prior to, during, or after installation on the Company’s Products. 

Any information or suggestion provided by the company with respect to the products including applications, specifications, and compliance with codes and standards, are provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The company makes no warranty that the products will meet buyer’s requirements, or that the products will be uninterrupted, timely, secure, or error-free. 

Limited Liability

THE WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES MADE BY THE COMPANY IN CONNECTION WITH THESE PRODUCTS. BUYER AGREES THAT THE COMPANY WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO THE PRODUCTS SOLD HEREUNDER OR OTHERWISE. 

BUYER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF THE PRODUCTS PURCHASED, WHETHER USED SINGULARLY OR IN COMBINATION WITH ANY OTHER PRODUCTS OR SUBSTANCES. 

THE COMPANY’S SOLE OBLIGATION UNDER THIS WARRANTY SHALL BE REPAIR OR REPLACEMENT OF NON-CONFORMING PRODUCTS, OR AT THE OPTION OF THE COMPANY, RETURN OF THE PRODUCT AND A REFUND OF THE PURCHASE PRICE. PRODUCTS SOLD BY THE COMPANY ARE SOLD ONLY TO THE SPECIFICATIONS SPECIFICALLY SET FORTH BY COMPANY IN WRITING. OTHER THAN THE LIMITED WARRANTY SET FORTH HEREIN, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. 

THE TOTAL LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE PRODUCTS SOLD HEREUNDER SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT TO WHICH DAMAGES ARE CLAIMED. 

ANNUAL INSPECTIONS:
